Before signing up or making a transaction with ASILVERSTAR printing services through https://www.asilverstar.my/ (herein referred the "Site" or "Website"), which is provided and managed by ASILVERSTAR COMPANY (herein referred to as "ASILVERSTAR", "we", or "us", please read the following Terms of Service carefully.

Your use of this Website constitutes your agreement to these Terms of Service. If you do not agree with any part of this Terms of Service, please do not access this Website.

We reserve the right to amend these Terms of Service at any time, with or without prior notice to Customers. You should review these Terms of Service each time you access this Site.

SECTION 1. SIGN UP

1.1 Sign up is free.

1.2 There is no legal age requirement for signing up. However, anyone below the age of 18 should obtain parental consent in using our services. We strongly recommend that parents and guardians supervise their children's use of the Website.

1.3 During the sign up process, you will be required to specify a valid email address and Password (your "Sign In Credentials") as well your basic information to maintain your account with ASILVERSTAR. You are fully responsible for maintaining the confidentiality of your password and for any consequences that may arise from you having granted a third party access. ASILVERSTAR has no duty or obligation to verify the identity of a customer and may assume, without independent investigation, that any person who logs on to this Site through your password does so with your consent and approval.

1.4 You are required to provide and maintain a valid email address with ASILVERSTAR at all times.

1.5 The management of ASILVERSTAR reserves the right to remove a customer's account at its discretion without prejudice.

1.6 You may close your account at any time. However, please email your request to us as proof. All remaining order print-ready softcopy(s) stored with account will be deleted from our servers upon the closure of your account.

SECTION 2. CUSTOMER RESPONSIBILITIES

2.1 You represent and warrant that:

• You are an authorised user of this Website;
• Any content that you transmit through this Website is not unlawful, including without limitation to matters that may be construed as an invasion of privacy, violation of a right of publicity, copyright, patent, or trademark infringement, and/or theft of trade secret or any other right of a person or party;
• All information that you provide to ASILVERSTAR on the Website is accurate and complete;
• You will be required to pay all fees and charges that are incurred by you or any other users of your account and credit card at the prices in effect when such charges are incurred.
• Certain orders shipped may be subjected to customs duties, taxes and other import charges which are not covered by the initial payments made to us. Therefore, you are responsible to pay for any such fees at the point of delivery.

SECTION 3. WITH PRINT-READY SUBMISSION

3.1 By submitting your print-ready softcopy(s) you agree that you aware and understand on how to design your product correctly.

3.2 All print-ready softcopy(s) must be e-mailed to us within 30 days of the Sales Quote date. Expired and/or invalid quotes are subject to quote revision.

3.3 ASILVERSTAR shall not be held liable for damage/loss of print-ready softcopy(s) during submission.

3.4 Your print-ready softcopy(s) is designed by you and ASILVERSTAR does not proof, edit, or change your content/design in any way.

3.5 You agree that it is your responsibility to review and check all your design for the following issues before emailing the print-ready softcopy(s) to us :

• Text issues:
  Spelling mistakes, grammar, unfinished text, missing text, hidden text, overlapping text, text in the gutter/binding area, text too close to the trim zone and text not within the safe zone area.
• Photo issues:
  Layout and arrangement, overlapping layers, subject in the photo in the gutter/binding area, subject in the photo too close to the trim line, subject in the photo not within the safe zone area, background not extended until the end of the page and any photo editing that was done to the photos using third party software.
• Design/creative issues:
  Dimensions & bleeds (min. 0.125in), resolutions (min. 300dpi), design layout, style, colour choices, fonts, linked files and other design elements imported into and/or print-ready softcopy(s) by you.
• Any other creative choices you made while designing your product.

3.6 ASILVERSTAR shall not be held liable for any errors as mentioned in 3.5.

3.7 Whilst the ASILVERSTAR staffs will pre-check your print-ready softcopy(s) to minimise errors, we cannot accept any responsibility for poor print quality as the quality of print is dependent on the image resolution quality and design elements image quality.

3.8 No changes will be made by ASILVERSTAR over the print-ready softcopy(s) once e-mailed to ASILVERSTAR for printing. You shall made those changes and (re) e-mail the new print-ready softcopy(s).

3.9 ASILVERSTAR will not be held liable for printed products that contains literature and/or images that are considered pornographic, offensive, inappropriate, copyrighted and/or trademarked.

3.10 Your order print-ready softcopy(s) will be stored on our drives up to a maximum of 6 months from the date ordered, for your ease of making repeat orders.

3.11 You warrant that you will not use any of the services for any fraudulent or illegal purpose.

SECTION 4. WITHOUT PRINT-READY SUBMISSION

4.1 A design fee for related graphical works and artworks may apply.

4.2 Design(s), artwork(s), hard/soft copy(s), sample(s), dummy(s), illustration(s) and/or appendix(s) shared via any social media platform, medium and/or transmission channel served as proofread and/or reference purposes only. Any unauthorised (re) transmission via any social media platform, medium and/or transmission channel for other than proofread and/or reference purposes is strictly prohibited.

4.3 These original design(s), artwork(s), hard/soft copy (s), sample(s), dummy(s), illustration(s) and/or appendix(s) are an intellectual property(s) and copyright(s) of ASILVERSTAR. Any unauthorised (re) production is strictly prohibited.

4.4 Message(s) expressed and/or conveyed in the design(s), artwork(s), hard/soft copy (s), sample(s), dummy(s), illustration(s) and/or appendix(s) are presented as per ordered. ASILVERSTAR will neither be responsible nor hold liability(s) for any controversial and/or offensive content, misleading and/or incorrect facts, legal and/or authorities claim arise.

4.5 Although we took reasonable efforts to eliminate technical error, clients are advised to proofread all design(s), artwork(s), hard/soft copy(s), sample(s), dummy(s), illustration(s), and/or appendix(s) before proceeding the order. ASILVERSTAR will not responsible for any typo and/or technical error that arise after approval is given.

4.6 Only client-proofread-and-approved version of design(s), artwork(s), hard/soft copy(s), sample(s), dummy(s), illustration(s) and/or appendix(s) will be print. It is typo-free and/or error-free. ASILVERSTAR will not responsible for any typo and/or error that arise after approval is given.

4.7 Softcopy(s) created will not be given.

SECTION 5. PAYMENT

5.1 All prices and amounts shown on this Site are in Ringgit Malaysia (RM), unless otherwise noted. All payment made shall be in Ringgit Malaysia (RM).

5.2 You agree to pay in full the actual amount of your purchase. We will not proceed with your order if you pay less than actual payment amount requested.

5.3 ALL payment(s) and cheque(s) should be made payable to ASILVERSTAR COMPANY.

5.4 This Site does not support any online transactions or merchant of payments.

SECTION 6. DELIVERY

6.1 All products will be delivered to Customers by ASILVERSTAR's appointed courier service company.

6.2 Products to be delivered to Customers are packed according to ASILVERSTAR's standard packing. ASILVERSTAR shall not be held liable for any delays caused by the courier service company.

6.3 Working days exclude weekends and public holidays observed in the country. Business days exclude weekends and public holidays observed in the country.

6.4 Shipping delays may occur if state holidays are being observed in the country.

6.5 If the incorrect products were couriered to you, ASILVERSTAR shall arrange for the product replacement and delivery of the right products to you at its expense.

6.6 Although the delivery service company we have engaged delivers to most places, some areas require longer delivery time due to inconsistent demand and sometimes lack of road infrastructure.

6.7 If you have not received your order within the specified delivery time, kindly contact the delivery service company with the Tracking/Consignment Note Number or you may contact ASILVERSTAR at hello@asilverstar.my no later than 7 days from the date of the specified delivery time. ASILVERSTAR will help liaise with the delivery service company on your behalf.

6.8 ASILVERSTAR is not liable for any loss and damage suffered by Customers through any reasonable or unavoidable delay in delivery.

6.9 Delayed delivery is not a basis for cancellation of the order or a request for compensation.

SECTION 7. CLAIMS & RETURNS

7.1 Descriptions, quantity, and pricing of order are understood, correct, and agreed upon.

7.2 Goods sold are tailored as per ordered, delivered client-proofread-and-approved goods in complete order are neither returnable, refundable nor exchangeable. Please check for goods condition and quantity delivered upon receiving goods.

7.3 Order is damaged or lost by the delivery service company. In such cases, sufficient evidence must be presented. Therefore, we reserve the right to have you return the original order before reprinting your correct order.

7.4 All claims for defects on your product order must be made in writing within 14 days upon the parcel's receiving date. If no such claims are made, you acknowledge that the product you have received is in good condition and that all the specifications had been met.

7.5 In the event of a claim, we will investigate thoroughly if the defects or errors are caused by us; thereof it is at our sole discretion should we choose to reprint the claimed product. Refunds and cancellation of an order is not provided.

SECTION 8. GENERAL EXPECTATION ON PRINTING OUTCOME

8.1 Due to other factors that are out of our control such as the different colour displays on various monitors, printed colours of end product may differ from what appears on your screen. Therefore, ASILVERSTAR cannot guarantee that the colours on what you printed will match exactly to what you see on your computer monitor.

8.2 We cannot guarantee 100% colour reproduction, as equipment, media, ink, as well as environmental concerns may affect the finished product; in that small variations in colour between first print and subsequent prints of the same product are expected.

8.3 Industry tolerance of the cutting edge is +/- 1.0mm.

8.4 Industry tolerance acceptance for sizes and measurements +/- 5%.

8.5 Printed surface dotted with dirt shall not be bigger than 0.3mm.

8.6 Customer may not reject an order if the defects are within the tolerance limit that have been stated.

SECTION 9. ASILVERSTAR'S INTELLECTUAL PROPERTY RIGHTS

9.1 The names, text, images and logos identifying ASILVERSTAR and their products and services are subject to copyright, design rights and trademarks of ASILVERSTAR. Nothing contained in these terms shall be construed as conferring by implication, estoppel or otherwise any license or right to use any trademark, patent, text, design right or copyright of ASILVERSTAR. Unless stated in written consent, a Customer or party has no right to produce, copy, disseminate the names, text, images and logos identifying ASILVERSTAR and their products and services. If ASILVERSTAR suspects a Customer has violated this condition, ASILVERSTAR reserves the right to remove that Customer's service account. ASILVERSTAR also reserves the right to take legal action against any Customer who misuses any trademark, patent, design right or copyright of ASILVERSTAR.

ASILVERSTAR services is provided and managed by ASILVERSTAR COMPANY ("ASILVERSTAR", "we" or "us"), respects your privacy, which includes the privacy of your digital photographs and your personal data you provide to us.

We limit access to your personal data to authorised ASILVERSTAR team members only. They (ASILVERSTAR team members) will only process your personal data on our instructions and they are subject to a duty of confidentiality.
We may collect or share your personal data and/or information with our trusted third-party service providers in order to:

• Fulfil orders of products such as payment and delivery.
• To ensure that your financial information is safe, not being used wrongfully and to prevent fraud.
• To ensure that you receive a better customer experience, by displaying relevant content and advertisements for you across websites.

We will not share, sell, rent, swap or authorise any third party to use your email address for commercial purposes without your consent.

5. Payment

This Site does not support any online transactions or merchant of payments. All payments are made payable to ASILVERSTAR COMPANY by client via electronic fund transfer.

Therefore ASILVERSTAR and its employees do not have access to your private information other than the information that you voluntarily submitted to us through the Site.

Proof of the successful transaction slips by indicating Sales Quote No. and/or Sales Invoice No.

Only transaction slips is used, collected, recorded or stored by ASILVERSTAR for payment processing.

5. General Security

ASILVERSTAR seeks to have reasonable security measures in place to help protect against the loss, misuse and alteration of the information given under our control. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. You acknowledge and agree that any information you transmit through the Website or upload for storage in connection with the website is transmitted or stored at your own risk.

If in the event you feel that your account has been compromised you must immediately notify us of the problem by contacting The ASILVERSTAR Crew at hello@asilverstar.my.

6. Design & Content

Upon submission of your project, you hereby acknowledge that the Contents of your order conforms to the rules and regulations as stated in our Terms of Service. ASILVERSTAR reserves the right to refuse printing of any orders that contain Content that breaches any of the agreements and privacy policies of the company.

We will not print or publish any products or its contents unless authorisation is given by the owner or author. It is your responsibility to alert ASILVERSTAR if your product orders contain any explicit or sensitive content such as nudity and/or profanity in order for special arrangements to be made when handling and producing your orders.

7. Order Submission

The product order’s content cannot be modified, changed or revised once your product design order has been submitted. ASILVERSTAR has no obligation to review the content that you have submitted and hence you hereby agree that your project has gone through the necessary proofs and checks until you have been fully satisfied, and that it is ready to be printed.

You agree and understand that your order file is free from any computer viruses, worms or any software intended to harm, damage or alter a computer system or data before submission.

8. Information from Other Sources

ASILVERSTAR may attain your personal Information from other sources such as via telephone or from other company websites. We may add this to the database we have already collected and collated to improve the products and services that we provide.

9. Email Provisions

By creating an account with us, your email address will be used as a communication tool in order for us to help keep you updated on our products and services. The emails sent from us to you may include (but are not limited to): product updates, company announcements, promotional content, contests and giveaways.

If you received an error email from us, please provide us feedback at hello@asilverstar.my

If you no longer wish to receive a specific form of email, you are free to unsubscribe to that particular type of email by following the "unsubscribe" instructions located at the bottom of each email sent.

10. Copyright

If you find that your original design (i.e. designs that do not utilise the ASILVERSTAR templates) has been copied or used in any other product design in any manner that constitutes copyright infringement, please contact us immediately.

We will investigate and undertake the necessary measures upon obtaining all the required information for verification and authentication.
